Activities requiring permits

Certain activities are regulated in the Antarctic and subantarctic

A range of legislation that implements Australia's obligations under various international agreements, regulates certain activities through permit systems, while prohibiting others altogether. The following list includes activities that may require permits within the context of the relevant legislation.

Antarctic Treaty (Environment Protection Act) 1980

  • removal of rocks, fossils, or meteorites;
  • activities involving or impacting upon wildlife:
    • sampling or interference with seals or birds including dead specimens, fur, feathers, bones, shells etc,
    • disturbance of wildlife, while on foot, or with an aircraft, vehicle or vessel in the Antarctic;
  • sampling or interference with plants or invertebrates from terrestrial or lake environments in the Antarctic;
  • entry into, and activities within, Antarctic Specially Protected Areas (ASPA's), historic sites or activities involving a historic site or monument;
  • introduction of non-indigenous species (such as animals, plants, viruses, bacteria, yeasts or fungi) into the Antarctic;
Antarctic Marine Living Resources Conservation Act 1981
  • scientific research or harvesting activities involving marine living organisms in the CCAMLR convention area (Antarctic and parts of the subantarctic);
Heard Island and McDonald Islands Environment Protection and Management Ordinance 1987
  • entry into the Heard Island and McDonald Islands and any proposed scientific, management or recreational activity;

Application for permit form

Environment Protection and Biodiversity Conservation Act 1999

  • any activity which is likely to significantly affect the environment ;
  • activities impacting upon EPBC listed species (including all Antarctic birds, seals and cetaceans);
  • the export of specimens overseas or other protected matters import of specimens into Australia;

The Department of the Environment and Water Resources web site has links to relevant EPBC permit application forms. Please note, however, that Antarctic activities involving Listed Marine, Migratory and Threatened Species can be applied for using the Antarctic Applications Online (AAO) System. Note for the Australian Antarctic Territory the matters protected under the EPBC Act include: Commonwealth land, Commonwealth marine, actions by the Commonwealth, and all types of EPBC listed species in a Commonwealth area.

Tasmanian National Parks and Wildlife Act 1970

  • entry to Macquarie Island Nature Reserve and any proposed scientific, management or recreational activity;

Weapons Ordinances 2001

  • the use of weapons in the Antarctic and in the Territory of Heard Island and the McDonald Islands;

Applications to use and possess weapons

The following list provides links to relevant forms for non-automatic weapon requests to:

  • possess an AAD owned weapon in accordance with section 8 of the Ordinance for AAT or HIMI;
  • use and possess a weapon in accordance with section 16 of the Ordinance in the AAT or HIMI for scientific purposes; or
  • to manufacture a weapon in accordance with section 13 of the Ordinance in the AAT or HIMI;
  • to display a historic weapon in accordance with section 14 of the Ordinance in the AAT or HIMI.

Note:

If a weapon is a registrable weapon in its State or Territory of origin, it must be registered in that State or Territory. Forms to register a weapon can be obtained direct from your local Police Station.

If a license or permit is required to use the weapon in its State or Territory of origin, the applicant must hold such a license or permit. Forms to apply for a license or permit to use a weapon can be obtained from your local Police Station.

To ensure that the Australian Antarctic Division Weapons Register is compiled and kept accurately, a copy of the registration showing ownership of the weapon as well as a copy of the licence or permit to use and possess the weapon are to be forwarded to the Antarctic Territory, Environment and Policy Section, Australian Antarctic Division, Channel Highway, Kingston, Tasmania 7050 as soon as practicable along with any request to use and possess a non-automatic weapon in the AAT or HIMI and no less than two prior to departure to the Antarctic or subantarctic.
